By accessing and using AccessiGuard's website accessibility testing service at accessiguard.app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

Description of Service

AccessiGuard provides automated website accessibility testing services that analyze web pages for compliance with accessibility standards, including WCAG (Web Content Accessibility Guidelines). Our Service generates reports identifying potential accessibility issues and provides recommendations for improvement.

Use of Service

Permitted Use

You may use our Service to:

• Test websites you own or have explicit permission to test
• Generate accessibility reports for legitimate business purposes
• Access and download your scan results

Prohibited Use

You may not use our Service to:

• Test websites without proper authorization
• Overload our systems with excessive requests
• Attempt to reverse engineer or circumvent our technology
• Use the Service for illegal activities or harmful purposes
• Violate any third party's intellectual property rights
• Distribute malware or engage in any form of cyber attack

Account Responsibilities

While our Service does not require account creation for basic scans, users are responsible for:

• Providing accurate information when making payments
• Maintaining the security of any access credentials
• All activities that occur under their use of the Service
• Complying with all applicable laws and regulations

Payment Terms

Pricing

Current pricing for our Service includes:

• Preview Scan: Free (limited results)
• Full Report: $15 (comprehensive accessibility analysis)
• Deep Scan: $45 (extended analysis with additional checks)
• Rescan: $5 (re-test previously scanned websites)

Payment Processing

• All payments are processed securely through Stripe
• Payments are required before accessing full reports
• All sales are final unless otherwise stated
• Prices are subject to change with notice

Refund Policy

We offer refunds in the following circumstances:

• Technical failures that prevent report generation
• Service outages lasting more than 24 hours
• Billing errors on our part

Refunds are not available for reports that are successfully generated but do not meet your expectations. Please contact us within 7 days of purchase for refund requests.

Service Availability

While we strive to maintain high service availability, we cannot guarantee uninterrupted access to our Service. We reserve the right to:

• Perform scheduled maintenance with reasonable notice
• Temporarily suspend the Service for emergency maintenance
• Modify or discontinue features with notice

Intellectual Property

The AccessiGuard service, including our scanning technology, reports, and website content, is protected by intellectual property rights. You receive a limited license to use the Service and access your reports, but may not:

• Copy, modify, or distribute our proprietary technology
• Use our trademarks without permission
• Claim ownership of our intellectual property

Data and Privacy

Our collection and use of your data is governed by our Privacy Policy. By using our Service, you acknowledge that:

• We will access and analyze submitted websites as part of our scanning process
• Scan results and metadata may be retained according to our Privacy Policy
• You are responsible for ensuring you have permission to submit websites for testing

Disclaimer of Warranties

Our Service is provided "as is" without warranties of any kind. We do not guarantee that:

• Our scans will identify all accessibility issues
• Following our recommendations will ensure full compliance
• The Service will be error-free or uninterrupted
• Our reports will meet your specific requirements

Limitation of Liability

To the maximum extent permitted by law, AccessiGuard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

Indemnification

You agree to indemnify and hold harmless AccessiGuard from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third party rights.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.

Governing Law
